Compulsory administration at Boerner Insulation Ltd.

Temporary compulsory management of Boerner Insulation Sp. z o. o. was established on July 25, 2023, by the decision of the Minister of Development and Technology based on the Act of April 13, 2022, on unique solutions for counteracting support for aggression against Ukraine and for the protection of national security.

 

The temporary management was established to sell the financial, funds, and economic resources owned by Boerner Insulation.

 

Mr. Paweł Rajmund Piotrowski was appointed the compulsory manager and took up this function on July 25, 2023.

By the decision of the Minister of Interior and Administration of May 29, 2023, Boerner Insulation was included in the list of entities for which the solutions listed in the Act, as mentioned above, are justified.

 

The reason was that the company’s largest recipients came from the capital group, controlled by two Russian entrepreneurs (beneficial owners) who were on the sanctions’ lists created after the outbreak of the Russian-Ukrainian war.

The effect of this decision was the freezing of all activities of the company, which, from that moment on, could not pay, order, sell, or produce. Thus, it was removed from economic circulation and could no longer operate on the market.

As a result, production was shut down at the factory in Wykroty, and the factory employees were forced to take temporary leave.

On June 2, 2023, the Head of the Internal Security Agency applied to the Minister of Development and Technology to establish temporary compulsory management at Boerner Insulation.

 

The measure used is necessary to ensure the functioning of the economic entity due to its importance in the construction materials market and maintaining employment.

Thanks to the introduction of compulsory management, the company was able to return to business activity after a two-month downtime, in particular:

  • The company’s ability to operate was unblocked – factory operations were restored,
  • Conditions for running a business were provided, and thus, the jobs were kept,
  • 200 jobs were saved at the factory in Wykroty,
  • Salary payments have been restored.

Efforts are currently underway to resume production and provide jobs as soon as possible:

  • Preparations are underway to resume three-shift production and the total return of the entire crew to work,
  • Plants are being cleaned, inventory is being put in order, preparations are being made to re-ignite specialist furnaces,
  • Outstanding payments to employees and contractors are settled,

Liabilities towards state institutions are regulated: tax offices, the social insurance administration, economic zone.

The compulsory management’s purpose is to sell Boerner Insulation’s assets – financial resources, funds or economic resources under management.
